Two cases of interest to Oliver readers
Ernest Krochak of Morning Star Rd – a lengthy and bitter neighbourhood battle of wills.
Complaints against 75 year old Krochak investigated by RCMP and charges laid – 4 counts of mischief and 2 counts of causing a disturbance. First four charges laid January 1 2013 and the last two January 7 2017. Crown counsel stated to the court Krochak has been on bail (on his recognizance – keep the peace) for some time and both the defense and the crown had agreed that if all is well for ten more months – the charges would all be dropped and a stay of proceeding entered into the records.
A date of June 5, 2019 set to review the file in this matter.
Judge Daneliuk heard one disturbing story from the defence – an incident in the hallway adjacent to the court this morning – with one complainant called before the judge.
An admission made that the complainant had used her middle finger when walking past the accused. The judge said she was very concerned that the bail might be breached – induced by persons wanting it to fail.
She admonished the complainant with “the court does not appreciate this type of behavior from adults”.

In a second case before the same judge:
James Darin Wiens – charged with 7 counts of matters under various provincial government statutes in regard to Game and Hunting Guides.
Some of the charges and incidents go back to October 1, 2015. Judge Daneliuk said she was very concerned about how long it had taken to lay charges and get the matters before the court.
Both defence and crown lawyers seem to agree that a “Joint Statement of Facts” was needed and the 51 year old Oliver resident had agreed to enter a plea. The judge Michelle Daneliuk indicated her wish that any guilty pleas would be entered Wednesday but stated she understood the resistance of lawyers to do that quickly.
She stated this matter must be resolved by November 30, 2018.
Wiens was seen at the courthouse but did not appear in the courtroom.
