Another day in court for Brian Louie, 39, who has been charged this year with a number of serious offences but wants to get out of jail.
Louie, of Oliver is charged in two separate incidents : assaulting police officers and entering a home near his and assaulting the residents.
January 5th – two counts of assaulting a police offer (45396)
February 24th – counts of assault with a weapon, assault causing bodily harm,  and a break and enter (45640)
Louie appeared in court via video from the Okanagan Correctional Centre at Oliver. Louie stated he has some problems and say he is willing to take treatment in a facility designed for *Indigenous Offenders.
Louie’s lawyer Nelson Selamaj admitted to this reporter before the hearing that the alibi defense was going no where with the RCMP not taking the statement of one witness who said she was with Louie at the time of the home invasion.
In the courtroom today Selamaj, attempted to persuade Provincial court Judge Greg Koturbash that his client should be released on strict conditions and a surety to be posted by the family.  Selamaj submitted “text messages” from a number of people saying Louie was with them the day of the home invasion incident.
Judge Koturbash said no to releasing Louie from custody – based on the family’s contention that the accused has mental health issues and a possible drug problem.  The judge referred to Louie’s history of violent criminal offences and a lack of compliance with court orders.
Next court date is March 14th – a remand.
March 28th – Louie and his co-accused, Dean Curtis Gallagher, 26, are scheduled to make an appearance together in provincial court in Penticton. Gallagher was quoted in court as saying “We don’t hang together” – but the Judge discounted any admission made by a co-accused.
