A brother and sister facing charges in the death of Roxanne Louie will have their trial venue changed.

Supreme Court Justice S. Dev Dley made the decision in Penticton after hearing from defence lawyers for Grace and Pier Robotti and Crown counsel.

Dley told court the application for a change of venue was based on two factors – publicity and security.

The Robottis are facing second-degree murder charges in the January 2015 death of Louie.

Among concerns expressed in an affidavit by Pier Robotti were that he had never seen a case so prominently featured in the media, that there have been widely publicized First Nations demonstrations and that concerning comments have been directed at him.

The accused was concerned he would not get a fair trial in Penticton, as the majority of people in the city are familiar with the case. He also felt threatened by badges worn by Louie supporters with the word “justice” on them.

Widespread sympathy for the victim would create an emotionally charged atmosphere, said the judge.

Dley said publicity is not a sufficient reason to change venue, and the local sheriffs do a good job at the Penticton courthouse. Nor is there anything wrong with members of the community advocating for justice, he said.

Crown counsel John Swanson said the Crown was strenuouly opposed to the move, as the trial should take place where the crime occurred.
