Special Open Thursday, November 13, 2014 at 4:00 p.m. Council Chambers.
According to a letter printed in the November 12th edition of the Oliver Chronicle, written by Al Hudec, he is; “disappointed that Councils’ decision to rezone the Megale property on Tuc-el-Nuit Lake to duplex development has now resulted in litigation”. He comments further; “…and Jim Wyse, the petitioner…etc.”
Further on in his letter Mr. Hudec comments that the situation causes the Town to lose additional tax base and the Developer his profit; “…costing the ratepayers upwards of $100,000 of legal fees”.
Although members of Council are bound by strict regulations spelt out in the Community Charter it was clear that this afternoon’s motion to postpone any further decisions on the matter of the Megale property rezoning is driven by this litigation. According the Mayor Hovanes; “Council requires time to consider options” therefore it voted in favor of a postponement until the next regular council meeting November 24th 2014.
A member of the audience questioned the short timeline and asked if this was enough time for Council to receive the necessary legal advice on the “alleged legal situation” was advised by the Mayor that the procedure requires that a date be set however Council will be moving this matter forward in an expeditious manner.
Another member of the audience questioned if Council had changed its mind; he continued to badger Council and the Mayor was forced to have staff respond. The audience member was not happy that Council would not respond directly to him and tried to confront Council on this protocol and then continued to interrupt the answer given by CAO Heidi Frank. She patiently completed her explanation of the rules which Council must follow. The audience member was heard to comment; “this is bull s..t”.
