Court documents released this morning indicated that crown and defence lawyers have agreed to a Judicial Interim Release hearing next Monday at the Penticton Law Courts in the case of two Oliver brothers charged with an incident last August in the South Okanagan.
On October 28th – Meg Shaw, Provincial Court Judge heard submissions from crown and defence on two brothers charged with possessing and throwing a bomb device last August in a residential neighbourhood in Oliver before ordering a 30 day psychiatric examination.
23 year old Eric Daoust and his 19 year old brother Stephan were sent to the Forensic Psychiatric Hospital in Coquitlam for examination. Both remain in custody.
The court was told the younger brother is also held on a charge of assault and other counts where a can of bear spray was thrown into a house in the 600 block of Earle Crescent in September.
Judicial Interim Release
Release from custody of a person charged with a crime while they are waiting for their trial or appeal.
Bail Hearing
A court hearing where a judge decides if an accused will be released from custody while awaiting their trial or appeal. May also be referred to as a show cause hearing or judicial interim release hearing. Bail may be granted and conditions of release set.
