Donald B. Lyons, 41, of Osoyoos was charged with assault and uttering a threat after police arrested Lyons in May. One charge laid because of an incident April 15 in Osoyoos and a second charge laid for an incident May 13.
Both situations relate to a girlfriend/partner.
Lyons was on parole at the time of the arrest and was returned to a federal facility in the Fraser Valley.
In the last two weeks – his lawyer received a waiver to have the matter sent to the provincial court in Abbottsford where Lyons entered a plea of guilty to one charge.
According to provincial court records from Abbottsford a stay of proceeding was entered on the assault charge and Lyons will serve a 30 day sentence and 3 years of probation on the uttering charge.
Lyons was sentenced to six years for drug and weapons offences in 2009.
Parole documents indicate that Lyons was a member of the Independent Soldiers and associated with the Hell’s Angels in Kelowna. Those documents outline how there were fears for Lyon’s safety outside and inside prison because of gang activity.
However Lyons had led an exemplary jail life since 2009 which led to his early release.
In a Penticton courtroom recently, Crown lawyers indicated Lyons was to be shipped to the Prairies to finish his sentence.
