A lawyer entered two NOT guilty pleas in Penticton Provincial Court today and asked for an early one day trial for Donald B. Lyons, 41, of Osoyoos.
Don Skogstad was appearing for his client who was not present due to his incarceration in the federal penitentiary system in the Fraser Valley.
Lyons was charged with two offences early this year and because of that his probation was revoked.
Skogstad told the court his client wants this current case tried as soon as possible allowing for an another parole application.
Lyons was sentenced to six years for drug and weapons offences in 2009 – but was released from custody last fall prior to the end of his sentence.
The current charges, assault and uttering a threat, laid by the crown after police arrested Lyons in May. The second charge because of an incident April 15 in Osoyoos and the first charge laid for an additional incident May 13. Both situations relate to a girlfriend/partner.
Police state and probation documents indicate that Lyons was a member of the Independent Soldiers gang and associated with the Hell’s Angels in Kelowna. Probation documents outline how there were fears for Lyon’s safety outside and inside prison because of gang activity. However Lyons had led an exemplary jail life since 2009 which led to his early release.
A Judicial Case Manager will set a trial date next Monday.
