The next RDOS meeting in Penticton, based on the agenda, could be a sleeper but one item caught my attention as it relates to an area south of Oliver and involves the irrigation right of way.
The problem. A house was constructed in 2009 without a permit in RDOS territory. It is occupied but the District has no record of it, no civic address, no legal road access, no building permit, no septic permit, the land is riparian in nature etc. The land is so remote it takes aerial photography to site it properly.
The area shown is legally in Area A Osoyoos but access is apparently on the Oliver Water Utility’s access lane.
The staff at the RDOS seeks injunctive action against the owner and ultimately a notice will be placed on the land title preventing any sale until all legal matters are cleared up.
